Tips to Hire a Good Personal Injury Attorney

Wondering what to do when you have been in an accident, a slip and fall, or a workplace injury? If you have already spoken with in insurance provider for your insurer, it may be time to consider a personal injury attorney.

The danger in running right out and hiring a personal injury attorney immediately after injury is that you will have to pay for their services out of whatever payout you ultimately get. So, it is typically wise to first speak with the relevant insurance provider and only then turn to legal alternatives. While speaking to the insurance company will in many situations resolve the issue completely, there may be some situations in which the insurance company either denies your claim entirely or decides to compensate you in a matter that is from your perspective insufficient. In such situations, the premium that you pay out to a personal injury attorney will come back to you in settlement damages many times over.

Now, once you are convinced that you need a personal injury attorney, you have to put forth the effort of first finding the right person for your case. Here are a few tips on selecting the right attorney for you:

There are a number of online databases of local and regional personal injury attorneys. While most of these are pay per listing or free submission, some actually do provide reviewing services. Even here, however, be wary of putting too much stock in a website’s recommendation as this information can be easily manipulated.

Using this online database and your local yellow pages as a sort of general list, it then becomes imperative to narrow this list by looking at the credentials of a particular attorney. Probably the best way to do this is to call your local legal aid clinic, which is free. While these individuals are not in the business of providing recommendations, the bar in a particular city for personal injury usually consists of about fifty to one hundred attorneys, so amongst attorneys word gets around pretty quickly as to who is good and who is not.

Another good resource is your city bar association. Your city bar will keep more general information about who has not been sanctioned by courts for malpractice and typically keeps a short list of recommended attorneys. But again, take this list with a grain of salt as there are manipulations going on behind the scenes here as well. Often a better tack is just to have a list of three or four attorneys you are considering and then call the bar association to hear their thoughts on each one.

Referrals can be good if you know someone in the legal community. But if not, the best you will get out of a referral is a sort of ‘he/she isn’t incompetent.’ Because let’s face it, most clients have no idea whether the settlement they received was in actuality the best they could have.

The final test should always be to meet with the attorney. In such a meeting you can discuss the payment method (contingency or flat-fee), but more importantly you want to try to assess if this individual seems competent. Note things like, what law school he/she attended? Did they pass the bar on their first try? How long have they been practicing personal injury in your state? Will they let you speak with some of their most recent clients? All of these factors taken together should give you a general impression of whether your personal injury attorney is competent, if not good.

Trademarks Explained

They’re everywhere you look, and yet do you really know what they are? Trademarks are a strange animal and it’s necessary that you get to know them if you have business endeavors of any kind. Whether you’re making your own trademark or using other trademarks, there’s a whole lot to learn.

The definition of trademark is a pretty simple one. It’s only later that the topic gets complicated. Basically, a trademark is just a sign of some kind that distinguishes a company from all the rest. Trademarks sit under the umbrella of “intellectual property.” A trademark can come in many different forms. Maybe it’s am image or a a turn of phrase. Paris Hilton was recently poked fun at for trademarking the phrase “that’s hot.” Indeed, there’s a lot of controversy over what can and should be trademarked.

Are you thinking about buying some intellectual property? If you do, you will be able to take people to court if they use your trademark without permission. It’s important that your company has a signature and unless it’s protected, it’s useless and can be used by just about anyone. A trademark might seem a simple concept enough, but if you overlook the issue, it could cost you a lot down the road.

When talking about trademarks, you’re bound to get into some murky water. For instance, some marks, logos, phrases, images, etc, become trademarks over time, if by chance they simply grow to become synonymous with a particular product or service. When we think of trademarks in this way, it’s pretty apparent that a trademark is not a narrow concept at all. Anything that conspicuously distinguishes something from something else, in a sense, can technically be a trademark.

What about those little circles with the “TM” and “R” in them? What do they mean? The “TM” refers to trademark and the “R” refers to a registered trademark. While they serve as gentle reminders that the trademark is protected by law, they aren’t necessary. There are both unregistered and registered trademarks out there, the latter obviously carrying more weight in a court of law. Most of the trademarks you see on TV and in magazines are registered.

Just as with physical property, intellectual property – when handled in court – is dealt with based on its jurisdiction.

There are five basic kinds of trademarks: distinctive, arbitrary, suggestive, descriptive, and generic. On the other hand, there are some symbols that can never be used in trademarks, like national flags. It’s also important to note that national and international trademark law vary, so especially if you are conducing business overseas, you should be aware of that.

A trademark can open your company up to all kinds of business and separate it from the pack, but if it’s not formed carefully, it may misrepresent and misdirect your company. So choose your trademark intelligently and make sure you understand the law backing it up so that you can put it to good work.

How To Fight Speeding Tickets

Speeding tickets are no fun. If you are pulled over for speeding and issued a citation legally, you do not need a lawyer unless you were also driving recklessly and are also cited for reckless driving. Speeding tickets are fairly straight forward, for the most part. However, depending on how much over the speed limit you were driving and which state you live in, your vehicle could be impounded (typically 40 mph over the speed limit). Additionally in some states, if you are under 18, your license may become suspended. But, if none of these conditions apply to you, you have the right to do two things: either pay the ticket, usually through mail, or else dispute the charge against you. After becoming aware of the law, I learned that anyone who pleads guilty on speeding tickets where they were cited for not speeding at all or cited for not going too much over the speed limit, subjects himself to unnecessary punishment from the law, since most speeding tickets of this type can be dismissed. I had a friend who was once cited for speeding when he was not and decided to fight the ticket.

So how do I fight a speeding ticket if I don’t think I was speeding?

Courts do not like to waste time and taxpayer dollars on petty crimes. To dispute a speeding ticket, you must within 10 days in most instances either sign the portion of the ticket that says “not guilty” and mail it to the place where you would send the payment for the fine or write a letter of dispute with the ticket number included in the letter, as well as your reasons for disputing the charges. In the written dispute, you must include ticket numbers, the date the ticket was received, the “act and section of the defense,” and your personal information. Thus, it depends on the state, but for the most part, states have a writing address where the dispute can be mailed. Check with your local county clerk to learn where to mail the dispute form.

After you have completed the dispute form, you will then wait to hear from the proper authorities, which will mail you a letter stating the date that your hearing will start. Make sure you attend the hearing and try to be at the courtroom at least 15 minutes prior to the start of the court hearing.

When the judge or district magistrate in some cases asks you how you plea, make sure you plead not guilty. He will then ask you to tell your story. As in my friend’s case above, he simply told him what had happened. He told the judge that when he saw the cop he looked at his speedometer and he was only going 35 mph in a 35 mph zone. The cop had cited him for going over 45 mph in the 35 mph zone. The cop was there and he conceded. At this point the judge will decide if your case is worthy of continuance and may possibly throw out the case or in the case of a district magistrate will decide your case; otherwise, in the case of a judge, you may be summoned to appear at another hearing at which your case will be decided.

Auto Injury Accident Compensation

Most road traffic accident compensation involves two drivers, with a driver or passenger from the one vehicle seeking compensation from the driver of the second vehicle. Based on evidence that the accident was caused through negligence. The road traffic accident compensation claim will lead to legal proceedings that will involve the driver and possibly, passengers of both vehicles claiming injury as a result of the negligent driving on one the parties behalf . Typically, legal proceedings due to poor road design, will be against a local council. This can be on the basis that they to have failed to install proper signs maintained proper design or maintain a A road, high street or motorway. A road traffic accident compensation claim may also include a product liability claim lodged toward the manufacturer of a car or car part, claiming design or manufacturing defect which lead to the accident. Also, if a car mechanic or garage left a car in an unsafe condition, liability may fall within their responsibility.

Unique situations can often arise in a road traffic accident compensation claim which make the legal proceedings more difficult. All parties involved may be liable for potential injuries and this will be considered during the course of any legal proceeding. Various issues that can arise from the accident itself include:

Leaving the scene of an accident: Is not so uncommon in the UK where the driver who causes an accident fails to stop at the place of the accident. This will make it difficult for the injured party involved make a positive ID and therefore bring the driver to court.
Pedestrians and Road Accidents: In such situations, a member of the public can suffer serious injuries as a result of a collision with a vehicle. Often time the conduct of the pedestrian is called into question making it difficult to make a claim against the driver.

Motorbike & Car Accidents: Motorcyclists are very much at risk in regards to personal injury when involved in a road traffic accident, even in collisions which would be relatively minor had they occurred between cars. Due to the nature of some motorcyclists, it may be prove difficult to obtain a far hearing from a jury as they’re commonly deemed ‘wreckless’ road users even if the other party is clearly at fault.

Bicyclists & Car Accidents: Bicyclists are among the most vulnerable road users. They are more likely to sustain serious injury when hit by cars or other vehicles. Various hazards such as doors opening in front of them are obvious causes of collisions as well as many others. Cyclists are often caught in the drivers blind spot and they often report that they did not see the bicyclist until it was too late.

Buses & Car Accidents: Bus accidents can also be quite serious. Due to the sheer size, passengers carried, a collision with a bus will not only see other road users worst off, but unmanaged passengers can also add to the already heated mix of a road accident. Any road traffic accident compensation claim will also be taken up with the operator of the bus not just the driver.

Unsafe road conditions: Where things like road debris and poor, uneven road surfaces abound, accidents can be common place. Whether this is in the form of parts which have fallen off of vehicles, or debris that is kicked up from the roadway, it can all be used as evidence in a road traffic accident compensation claim if the driver believes this was the cause of the accident.

Legal Help – Getting a Green Card

You must be aware that if you want to become a US green card holder, you will have to spend a lot of your money and time. Foreign citizens who want be a US citizen should be prepared for this and if you want to make the process a lot smoother, you should seek the necessary legal help.

Because of the stringent policies in the US when it comes to acquiring green cards, many foreign citizens are illegally residing in many different states. According to some critics, the system being used by the US should be made simpler but since you’re the applicant for the green card, you should follow their rules.

Before the green card was colored green but at present, it is already white colored with green printings; the card is valid for 10 years and a foreign citizen can get it when their employer or relative petitions them.

By seeking the needed legal help, you will be able to go through with the various steps smoothly. Start looking for lawyers who are specializing in green card cases. Once you find a reputable lawyer, you can already follow the three steps.

Step #1

The USCIS (US Citizenship & Immigration Service) is the agency that issues green cards to foreign citizens. You will need to submit all the pertinent paperwork to this agency and their staff will review your papers. After that, the agency will determine if your papers will be approved or not.

Step #2

After the decision of the USCIS is given, the paperwork will be forwarded to NVC (National Visa Center). Your green card petition will need to wait until there is already an available visa number. Every year, limited visa numbers are released; so don’t expect for an immediate visa number.

Step #3

Once a visa number is given to your petition, it will be forwarded to the US embassy which is based in your home country.

As you can see, the three steps may sound simple and easy but it’s not as simple as you think. There’ll be lots of paperwork and the whole process is quite time consuming. You have to devote a lot of your time in preparing the necessary paperwork and not only that, you will also spend a lot of money.

If you want to prepare all the necessary paperwork without any problems, you should seek legal help. Find a reputable lawyer now who has past experiences in handling green card matters. Due to the extensive paperwork, you will need a guide all throughout the process. Private lawyers can cost a lot in the long run and you should be prepared for such expenses.

However, if you have a personal lawyer, you can be sure that all the paperwork is accurate and there’ll be less room for mistakes. That way, the papers will be immediately processed in the concerned agency. Having complete and accurate paperwork will make it easier for the concerned agencies to process the green card petition.

Hire a lawyer who knows a lot about green card petitions. You can ask referrals from friends and relatives or you can also do a quick search online for reputable and experienced lawyers in your area. This is one sure way of getting your green card petition approved in less time. Be prepared for everything.

What Is A Judgment Lien?

A judgement lien is a court ordered lien that is placed against the home or property when the homeowner simply fails to pay a debt. This doesn’t seem like a big deal, but when the homeowner has a judgement lien against his or her home and wants to sell it, the judgement lien has to be paid in full before the home or property can be sold. judgement liens can be placed against the property for a variety of reasons such as unpaid credit card bills, utility bills, department store bills, landscaping or home improvement bills, and just about any bill that the homeowner has failed to pay in a reasonable amount of time. Any bill that can cause one to end up in court can result in a judgement lien.

A judgement lien is different than a trust, in that the judgement lien holder cannot foreclose on the home or the property as trust holder can. judgement lien holders can demand payment, but ultimately they must wait for the homeowner to sell the property before they can expect to be paid the money that they are owed according to the judgement. Luckily for the judgement lien holder, the court will typically assign an interest rate to these liens so that the lien holder is compensated for their waiting as the interest will continue to accrue until the debt is paid in full. Because the majority of people will live in their home for quite some time, the interest can make a judgement lien grow, and grow, and grow over the years so that it is quite large. Imagine what a lien of just $3,000 would grow to over the years if the interest rate were 15% annually and that would be an even bigger amount if the debt were $5,000 or $10,000!

Of course, judgement liens require court action. A creditor will take the homeowner to court where the judge will determine if the homeowner does in fact owe the creditor any money. If the court decides that the creditor is owed the money, and the homeowner will not or cannot make payment, the judge will order that a judgement lien be placed against the property. The judgement lien will then be entered into land records offices for the city or county so that the home cannot be sold without repayment of the debt. Once the lien is filed with the land records office, the judgement lien is said to be attached to the property, meaning that it cannot legally be sold without paying off that lien. If the judgement lien is not listed at the land records office, then it means that the debt or lien is not legally attached to the property and does not need to be paid off to sell the home.

A home or property can have numerous liens against it, which may present a problem when the home is to be sold. Fortunately, the law says that liens will be paid off in the order that they were attached to the property, meaning the first lien will be paid first, the second will be paid second, and so on. This is a law that was basically developed for when a home is foreclosed on. If a foreclosed home is auctioned it will first pay off the first lien, then the second, and the third until there is no money left to pay the debts that are still attached or associated with the home. Of course, all trusts against the house, such as mortgages and home equity loans, would be paid off before the judgement liens, so it’s not uncommon for these liens to simply go unpaid because there is no money remaining to pay these debts after the trusts are paid. If there is not enough money to pay for all of the judgement liens and trusts on the home or property, they are then wiped out and can no longer be collected on. Of course, the auction will usually attempt to pay for all of these debts, and they are paid for until there is no money. The reason for this is that the new owner will not be able to get any home equity loans or second mortgages with judgement liens already on the home. If there is money left over after everything is paid off, the remaining amount would go to the foreclosed homeowner as all debts are paid.

You can look for judgement liens at the land records office, though you will typically not find them listed with trusts. Investors or homeowners looking to sell their home will have to look into both trusts and judgements, as they are listed in different areas. Investors can often be caught off guard when they realize how much debt is attached to the home, and sellers are often startled at old judgement liens that they had forgotten about and don’t want to afford to pay off in order to sell their home. It’s a good idea to go over all of this information before one bids on a home or attempts to sell it or put it on the market.

judgement liens are not something that anyone wants put against their home, but they are common enough. There comes a time for many people when they simply cannot pay a bill, and a judgement lien is ordered. Making a continued effort to pay down the debt is a great idea so that you don’t acquire large interest fees in addition to the initial dollar amount of the lien. The homeowner does not have to wait until the home is sold to pay off the lien, instead they can be paid off as soon as possible. The judgement lien is simply put in place so that the home cannot be sold without the debt being paid, and when you look at it from the creditors point of view, this is a great tool to ensure that you’ll eventually be paid the amount you are owed in addition to an interest fee that will pay you for waiting.
